Terms and Conditions

Acceptance, changes, cancellations, and requested return of orders:

All purchase orders are subject to acceptance by a duly authorized agent of Brevan. Each order upon acceptance is a binding contract and cannot be amended or altered without mutual agreement of both “seller” and “buyer”. Reasonable cancellation charges may be applicable due to the nature of the product returned, cancelled, etc. All custom and non-standard products are considered “specials” and are considered “non-cancelable, non-returnable”.

All prices quoted and shipped by Brevan will be done so as F.O.B. shipping point. All title and risk shall pass to the buyer upon delivery to the appointed carrier. All products shipped by Brevan are packaged with care in full compliance of carrier and supplier requirements. Any and all subsequent claims for loss must be made by the buyer. Suspected damage or loss must be reported by the buyer to the carrier as soon as possible to insure satisfaction of claim.

Delays in scheduled deliveries due to “acts of god”, strikes, and all causes which are beyond the reasonable control of Brevan will not result in the “seller” being liable. Where ever possible, delivery information will be amended to reflect those conditions above.

Requests for any return of product must be pre-approved by an authorized agent of Brevan Electronics. Upon approval, the customer will receive an approved RMA number which must accompany the product when returned. Failure to obtain pre-approval of return may result in product being refused and returned by Brevan. Upon receipt of approved returns, the product will be subject to inspection and validation of product and quantity prior to credit or replacement being issued.

Please contact authorized Brevan representative to obtain RMA (return material authorization). The RMA must be obtained prior to the return of the product. Product returns must be made within 30 days from the date of invoice, aco=companied by a description\details of return. Associated freight charges are the responsibility of the buyer. Request for defective material returns must be made and completed within 30 days of the original invoice date.

Terms of Sale

Brevan Electronics’ standard terms, unless otherwise specified, are net 30 days. Past due items are subject to a monthly late payment fee as allowed by applicable laws.

Brevan sales via internet shall be processed via credit card.

A minimum order of $50.00 for domestic orders and $100.00 for international orders applies to all accepted orders. In regards to International orders, the buyer shall be responsible for all duties and taxes applicable to the shipments. All international orders are exported in accordance with U.S. Export Administration Regulations.

Website Access

All customers are required to register in the appropriate are of the Brevan web site in order to place purchase orders on-line. It is the buyer’s responsibility to insure that only authorized representatives of the buyer have access to the “user name and password”. Should the buyer believe the user name or password has been lost, stolen or misused, please contact a Brevan representative immediately. The buyer recognizes that the use of the Brevan web site is done at its own risk. Brevan makes no claim that the information stored on the site that the service will be secure, uninterrupted or error free. The Brevan web site contains links to many third parties (suppliers). Brevan is not responsible for any content or operation of such sites nor any loss experienced by the content of such sites.

Taxes

Brevan Warranty and Disclaimer

Brevan, acting as a distributor of products manufactured by independent companies shall not be responsible for any subsequent damages or losses resulting from product sold. All warranties and guarantees are limited to those extended by the supplier of goods to Brevan. Any such warranties or guarantees shall be extended to the buyer when applicable. All recognized warranties shall become dismissed should any products sold to buyer be altered or modified in any manner.

Products sold by Brevan are not authorized for any application or manner in a life support of system device. Any such goods are purchased at the sole risk of the buyer.

Brevan reserves the right to make amendments or modifications to the site and\or the terms and conditions at any time without prior notice.

Unlawful Use of Brevan Products, Confidential Information, Website

Any party or organization attempting or committing an unlawful act regarding any of Brevan properties, both physical and intellectual shall be punished to the fullest extent of the law.

All sales shall be governed by the laws of New Hampshire, United States of America.
